1. Purpose
These General Terms and Conditions of Sale (GTC) are intended to define the terms and conditions of booking and stay at MH Hotel & Spa, made via the Elloha online booking platform.
Any reservation implies full and complete acceptance of these General Terms and Conditions as well as the specific conditions of the reserved rate.
2. Capacity to contract
The client acknowledges being of legal age, having the legal capacity to contract and make the reservation for personal purposes, not within the scope of a professional activity.
3. Reservation
Booking is done online via the Elloha platform.
The customer selects the desired services and acknowledges having read their nature, characteristics and applicable terms of sale.
The reservation becomes firm and final after validation of the booking process and receipt of a confirmation email.
4. Rates and taxes
Prices are shown in euros (€), inclusive of all taxes (TTC), per room and for the selected dates.
The tourist tax, the amount of which is set by the competent authorities, is charged in addition and paid on site.
Depending on the time of year and availability, the establishment may offer different types of rates, including:
- a flexible rate;
- a non-refundable fee.
The specific conditions applicable to each rate are specified at the time of booking.
5. Payment terms
The customer's bank details are requested in order to guarantee the reservation.
For reservations not involving prepayment, no amount is debited at the time of booking.
Payment for your stay is made directly to the establishment, unless otherwise specified in the chosen rate. The applicable payment methods are detailed at the time of booking.
6. Cancellation, modification and no-show conditions
6.1 Non-refundable fee
When this rate is offered, reservations made at the non-refundable rate cannot be modified, cancelled or refunded.
The sums paid at the time of booking constitute a deposit and remain the property of the establishment.
6.2 Flexible pricing
For flexible rate bookings, cancellation is free up to2 days before the arrival date at 12:00 PM.
After this period, as well as in the event of a no-show, 100% of the amount of the first night will be charged as compensation.
In accordance with Article L.221-28 of the Consumer Code, accommodation services provided on a specific date or at specific intervals are not eligible for the right of withdrawal.
7. Hotel stay
Rooms are available from 4:00 PM on the day of arrival and must be vacated by 11:00 AM on the day of departure.
A valid form of identification may be requested upon arrival.
Adult clientele only
MH Hotel & Spa is an establishment exclusively reserved for an adult clientele.
In order to preserve the tranquility of the premises, the relaxing atmosphere and the comfort of all our guests, only persons aged 18 years or older on the date of arrival are admitted.
Consequently, reservations including one or more minors, even if accompanied by a legal representative, cannot be accepted.
In the event of non-compliance with this condition, the establishment reserves the right to refuse access to the hotel without any compensation or refund being claimed.
Any behavior that disturbs the peace and quiet of the premises, disrespects other customers, or disrupts the proper functioning of the establishment may result in the immediate exclusion of the customer, without refund.
8. Responsibility
The photographs, illustrations and descriptions appearing on the website are presented for informational purposes only and are not contractually binding.
The establishment cannot be held responsible for the non-execution or improper execution of the reservation in the event of force majeure, due to the client or a third party.
In the event of force majeure as defined by French case law, each party is released from its obligations for the duration of that event.
The establishment cannot be held responsible for the loss, theft or damage of personal belongings when its liability cannot be engaged in accordance with applicable legal provisions.
9. Protection of personal data
The personal data collected is necessary for managing reservations, executing the contract and monitoring the customer relationship.
They are processed in accordance with the General Data Protection Regulation (GDPR) and applicable French legislation.
The customer has the right to access, rectify, erase, limit, object to, and transfer their data, under the conditions provided for by the regulations in force.

10. Consumer mediation
In accordance with Articles L.612-1 et seq. of the Consumer Code, the customer has the option of using a consumer mediator free of charge in order to resolve amicably any dispute between him and the establishment.

Recourse to the mediator can only occur after a written complaint has been sent to the institution and in the absence of a satisfactory response.
11. Applicable Law
These General Terms and Conditions of Sale are governed by French law.
Any dispute relating to their interpretation or execution shall fall under the jurisdiction of the competent French courts, subject to the applicable mandatory legal provisions.
